USER AGREEMENT ON THE WEBSITE PHTOZA.COM
This agreement (hereinafter "Agreement") is between you (hereinafter "Customer") and the website Photoretouchingservices.net (hereinafter "Contractor"). Using Photoretouchingservices.net constitutes your agreement to all terms of this Agreement. If you do not agree with these terms and conditions of the Agreement, you should leave the site immediately. The text of the Agreement is a public offer. The adoption of this Agreement is the service ordering from the Contractor, and the Customer is considered to be the person entered into a partnership with «Photoretouchingservices.net».
Rights For Data:
By sending an image for digital retouching to the CONTRACTOR, you provide the Contractor with the rights to copy, perform, transmit, modify, and edit any messages or pictures received by the CONTRACTOR strictly for carrying out the order.
You acknowledge that you are aware of the rules of intellectual property rights and understand them, in particular, the rules on copyright and trademark rights protection, and that all of the images, data and / or messages, sent to the CONTRACTOR, do not violate the laws of intellectual property protection.
You agree that you must not provide any images, on which you do not own the copyright or the right to use.
Information Security:
The information is transferred through the encrypted HTTPS protocol, by using encryption technology. Photoretouchingservices.net makes every effort to ensure the security and confidentiality. You acknowledge that the transmitted messages and images can be read or intercepted by third parties. You agree that if such interceptions take place, the CONTRACTOR is not liable in any manner with all applicable laws and in any jurisdiction.
Refund Policy:
In case of dissatisfaction with our work, the money won’t be returned, but you can ask for review within 30 days from the day you submitted your order. We will make amendments to the same pictures for free. See. The Policy Of Refinements, details below.
The Policy Of Amendments (Refinements):
- We accept applications for revision within 30 days after order placing. If you do not take any action within 30 days, your order will be closed automatically with no possibility to be reopened. You will need to place a new order for photos editing;
- The instructions noted in the comments to the revision should not contradict the instructions given in the comment to the order when the order was placed.
Photo Replacement:
We do not accept the replacement of the photos after the order is placed. If you sent us a wrong picture, you have no rights for free edition of the replaced photo. You agree that you are solely responsible for the consequences of sending the photo to us.
Data Storage:
When the order is done, all the data from your order will be deleted from our servers in 30 days.
Force Majeure:
Both Parties are not responsible for any failure to perform obligations under the Agreement for the period of force majeure. Force majeure refers to extraordinary and compelling circumstances under the given conditions which prevent the execution of the obligations of the Parties under this Agreement. These include natural disasters (earthquakes, floods, and so on), circumstances of social life (war, states of emergency, strikes, epidemic, expanding of ATO zone by uncontrollable actions of foreign civilizations, and so on), governmental prohibitive measures of transportation, foreign exchange restrictions, international sanctions, a ban on trade, and so on. n.). During this time, the Parties do not have any mutual claims, and each side takes consequences of force majeure.
Period of the Contract:
This Agreement enters into force on the date of Order placing and ends when the Parties fully fulfill their obligations.
The Contractor reserves the right to amend this agreement unilaterally from the moment of its conclusion.
Photoretouchingservices.net and employees under any circumstances are not liable for any damages or incidental damages, which may arise directly or indirectly from any messages and/or pictures for personal, non-commercial and commercial use.
